Sacramento – AB 1651 by Assemblymember Eloise Gómez Reyes, a bill ensuring community college faculty receive due process rights was signed by Governor Brown. AB 1651 requires that community college faculty on administrative leave receive information on the reason for the administrative leave.
“Until now, Community college faculty would be disciplined by their respective districts without any notification of the charges against them or the reason for the disciplinary action,” said Assemblymember Reyes. “Providing basic due process is fundamental to any disciplinary proceeding to ensure a fair and equitable system that keeps all parties accountable. AB 1651 provides that protection.”
AB 1651 would modify existing due process rights for community college faculty members by providing them with the general nature of the complaint made against them. It also implements a process by which the California Community College Chancellors office is urged to resolve investigations within 90 days to avoid faculty members being left on involuntary paid leave as a form of punishment. AB 1651 came about after several faculty members from around the state reported being placed on paid administrative leave without ever receiving notice of the reasoning, nor without any ability to appeal the decision.
