If you or someone you know is an immigrant, it is vital to understand that rights are protected regardless of immigration status.

  • Remain Silent - You have the right to remain silent; if you do not have immigration documentation, ask to speak with an attorney.
  • Do Not Open the Door - You do not have to let officials into your home unless they present a warrant signed by a judge. An arrest warrant must name a person in your residence. A search warrant must include an address and the areas to be searched within the residence. If they don’t produce a warrant, keep the door closed and state, “I do not consent to your entry.”
  • Do NOT Sign Anything - Ask to speak with an attorney and do not sign any documents without your attorney being present.

The National Immigration Law Center (NILC) has shared resources for employers on how to protect their workers should ICE attempt to enter your place of work. Here are some items listed on the NILC guide for employers on what to do if immigration comes to your workplace.

  • Employers are encouraged to:
    • Train their workers to NOT allow ICE agents to enter the workplace.
    • Train all workers NOT to interact with ICE agents. If ICE agents have questions or requests, your employees should say nothing or say, “You are not allowed to enter. Talk to my employer.”
    • Employees can say, “I cannot permit you to enter. You must speak with my employer.”
  • As an employer:
    • You have rights when ICE goes to a business. ICE does not have the right to enter your business, stop or arrest workers, or take documents.
    • Work with community or legal groups to arrange a “Know Your Rights” training for you and your staff.

  • Derecho de Permanecer en Silencio - Tiene el derecho a mantenerse en silencio. Si no tiene documentos migratorios, pida hablar con un abogado.
  • No Abra la Puerta – No tiene que permitir que los oficiales entren a su casa a menos que presenten una orden firmada por un juez. Una orden de arresto debe nombrar a una persona en su residencia. Una orden de cateo debe incluir una dirección y las áreas que se buscarán dentro de la residencia. Si no le presentan una orden, mantenga la puerta cerrada y diga “No doy mi consentimiento para que entre”.
  • No Firme Nada – Solicite hablar con un abogado y no firme ningún documento sin que su abogado esté presente.

El Centro Nacional de Derecho de Inmigración (NILC, por sus siglas en inglés) ha compartido recursos para empleadores sobre cómo proteger a sus trabajadores en caso de que ICE intente ingresar al lugar de trabajo. Aquí hay algunas recomendaciones listadas en la guía de NILC para empleadores sobre qué hacer si inmigración viene a tu lugar de trabajo.

Se recomienda a los empleadores que:

  • Capacite a todos los trabajadores para que NO permitan que los agentes del ICE ingresen en su lugar de trabajo.
  • Capacite a todos los trabajadores para que NO interactúen con los agentes del ICE. Si los agentes del ICE les hacen preguntas o les piden algo, los trabajadores deberían callarse o decir: “No está autorizado a entrar. Hablé con mi empleador.”
  • Un trabajador puede decir: “No le puedo dar permiso para entrar. Tiene que hablar con mi empleador.”

Como empleador:

  • Usted tiene derechos si ICE llega a su trabajo. Los agentes del ICE no tienen el derecho a ingresar en su lugar de trabajo, detener o arrestar a los trabajadores, o llevarse documentos.
  • Trabaje con un grupo legal o comunitario para coordinar una capacitación sobre “Conozca Sus Derechos” para usted y su personal.
